Electronic Transactions Act consultation open

The Government is seeking feedback on, and experiences with, the Electronic Transactions Act 1999 (Cth) (ETA) – including the consent requirements, e-signature verification, electronic records, and exemptions to the ETA.

Consultation is open from 23 January to 20 March 2023.

The ETA provides that Commonwealth legal requirements to send, sign or record written information can be done using electronic tools, so long as accessibility and accountability safeguards are met.

Feedback from this process will help shape the effective implementation of the ETA to make Australian e-commerce clearer, more accessible and more consistent.

This consultation is part of ongoing work on Modernising Document Execution.
